As part of
its campaign to gain exclusive rights to the Functional
Independence Measure for itself and MedTel Outcomes,
UDSMR sued
IT HealthTrack on June 14, 2004, alleging copyright
infringement. ITH
responded on July 22, 2004 with eleven affirmative
defenses and seven
counterclaims against UDSMR, including misuse of
copyright, attempted
monopolization, additional federal and state antitrust
violations, false
claims, and interference with existing and prospective
contractual
relationships. ITH intends to continue to serve all of
its customers.
UDSMR's complaint and ITH's answer, affirmative defenses
and
counterclaims are available through the Public Access to
Court
Electronic Records (PACER) system. If you wish to view

have your attorney obtain them from the US Federal Court
in the Western
District of New York via PACER (Docket #
1:04-CV-00443-JTE).
ITH urges each interested person to decide for itself
whether UDSMR's
claims of ownership are true, and whether control of the
Functional
Independence Measure by a single enterprise seeking
maximum advantage is in the best interests of the
